1. Overview
DeTonic respects the intellectual property rights of others and expects users to do the same. This Copyright Policy explains how we protect against copyright infringement, how rights holders can submit takedown notices, and what happens when our content filter detects a potential violation.
DeTonic operates as an intermediary under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We have registered a DMCA agent with the U.S. Copyright Office and respond promptly to valid takedown notices.
2. DeTonic's Copyright Filter
Before generating audio, DeTonic applies an automated content filter to every user prompt. The filter:
- Screens for explicit song reproduction requests: Prompts that name specific copyrighted songs, artists, or albums with intent to reproduce their musical expression are blocked.
- Detects circumvention attempts: Encoded, misspelled, or obfuscated versions of blocked terms are matched against our violation patterns.
- Logs violations: Blocked prompts are recorded with session ID, prompt text, violation type, and matched terms. Strike counts are tracked per session.
What the filter does not do: It cannot guarantee that output audio is free from all potential copyright claims. Audio synthesis does not inherently produce exact reproductions, but acoustically similar results are possible for similar prompts. The filter is a best-effort preventive measure, not a legal guarantee.
DeTonic's synthesis engine generates original PCM audio from scratch — it does not sample, replay, or remix existing recordings. The risk profile is similar to a musician who has heard many songs composing in a genre: outputs are original compositions, but superficial similarities to existing works are possible.
3. User Responsibilities
By using DeTonic, you represent and warrant that:
- You will not use the Service to reproduce, replicate, or create substantially similar versions of copyrighted musical works.
- You understand that Generated Tracks may bear superficial similarity to existing music and that you bear responsibility for reviewing tracks before high-stakes commercial use.
- You will not submit DMCA takedown notices in bad faith or for competitive harassment purposes.
- You will not attempt to circumvent the content filter through encoding, creative misspelling, indirect descriptions, or other obfuscation techniques.
- You will indemnify and hold DeTonic harmless from any claims arising from your downstream use of Generated Tracks in violation of applicable copyright law.
4. DMCA Takedown Procedure
If you are a copyright owner (or authorized to act on their behalf) and believe that content on DeTonic infringes your copyright, submit a written notice containing all of the following:
Required Elements of a DMCA Takedown Notice
- Identification of the copyrighted work: Describe the copyrighted work you believe has been infringed. If multiple works are covered by a single notice, provide a representative list.
- Identification of the infringing material: Describe the infringing content on DeTonic and provide enough information for us to locate it (e.g., the URL to the track, the track ID, or a description of where you encountered it).
- Your contact information: Full name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

Upon receiving a complete and valid takedown notice, we will:
- Promptly remove or disable access to the identified content.
- Notify the user who generated the content that it has been removed.
- Log the takedown for our repeat infringer tracking.
Incomplete notices will not be processed. We cannot respond to notices that omit required elements.
5. DMCA Counter-Notice Procedure
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the content that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Wayne County, Michigan if outside the US), and that you will accept service of process from the complainant.
Send counter-notices to copyright@detonic.app with the subject line "DMCA Counter-Notice."
Upon receiving a valid counter-notice, we will forward it to the original complainant and reinstate the content after 10–14 business days unless the complainant notifies us they have filed a court action.
6. Reporting Potential Infringement
If you encounter a Generated Track on DeTonic or published elsewhere that you believe infringes a copyright, you can:
- File a DMCA notice as described in Section 4 above.
- Send an informal report to copyright@detonic.app describing the concern. Informal reports do not trigger legal obligations under the DMCA but allow us to investigate and improve our content filter.
We investigate all reports in good faith. Reports submitted in bad faith (e.g., to harass competitors or interfere with legitimate creative work) may result in the reporter's account being suspended.
7. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), DeTonic maintains a policy to terminate accounts of users who are determined to be repeat infringers.
An account will be flagged for review when:
- The content filter records three or more violations within a 30-day period.
- A valid DMCA takedown notice is received identifying content generated by that account.
Accounts with confirmed infringement patterns will be suspended. Accounts that receive two or more valid DMCA takedowns resulting in removals will be permanently terminated.
Users may appeal terminations by contacting support@detonic.app within 14 days.
